What is Intentional Harassment, Alarm or Distress?
This offence occurs when a person uses threatening, abusive, or insulting words or behaviour, disorderly behaviour, or displays any writing, sign, or representation that is threatening, abusive, or insulting, with the intent to cause and thereby causing harassment, alarm, or distress.
It often arises in situations where:
Threats or abuse are directed at a specific individual.
There is actual evidence of the victim experiencing harassment, alarm, or distress.
The offence involves homophobic or racist abuse, or ‘tragedy chanting’ aimed at a specific person who has described the impact.
Court and Sentencing Information
This offence is usually dealt with in the Magistrates’ Court.
However, if charged as a racially aggravated offence under Section 31(1)(b) of the Crime and Disorder Act 1998, it can be escalated to the Crown Court.
Maximum penalty: 26 weeks’ imprisonment.
Custodial sentences are sometimes imposed based on the seriousness of the offence.
